By accessing or using the NexBuild AI website (nexbuildai.com) or our development services, you agree to be bound by these Terms of Service. If you do not agree, please do not use our website or services.

2. Services

NexBuild AI provides AI and custom software development services including but not limited to: web applications, mobile apps, AI tools, SaaS platforms, automation systems, CRM development, and related digital services. Specific service terms for each project are governed by separate project agreements.

3. Project Agreements

All development projects are governed by a separate project agreement or proposal that outlines the scope of work, deliverables, timeline, payment terms, and intellectual property rights. These Terms of Service apply in addition to any project-specific agreement.

4. Intellectual Property

Upon full payment of all agreed fees:

• All custom code, designs, and deliverables created specifically for you become your property.
• Any pre-existing code, frameworks, or tools (open source or proprietary) used in building your project remain owned by their respective creators.
• NexBuild AI retains the right to display completed projects in our portfolio unless a specific confidentiality agreement is in place.

5. Payment Terms

Payment terms are specified in individual project proposals. Generally:

• A deposit is required before work begins.
• Milestones may require payment before proceeding.
• Final payment is due before final code delivery.
• Overdue payments may result in work being paused.

6. Confidentiality

We treat all client information, project details, and business plans as confidential. We are happy to sign a mutual NDA before detailed project discussions. See our Privacy Policy for more on how we handle your data.

7. Limitation of Liability

NexBuild AI will not be liable for any indirect, incidental, or consequential damages arising from the use of our services. Our total liability in connection with any project shall not exceed the total fees paid for that project.

8. Warranties

We warrant that our services will be performed with reasonable skill and care. We provide a 30-day bug fix warranty on all completed projects for defects directly caused by our development work.

9. Prohibited Use

You may not use our website or services to:

• Create or distribute malicious software, malware, or harmful content.
• Engage in any illegal activity.
• Infringe on the intellectual property rights of others.
• Attempt to gain unauthorised access to any systems.

10. Governing Law

These terms are governed by the laws of India. Any disputes shall be resolved through good-faith negotiation, and if necessary, binding arbitration in India.

11. Changes to Terms

We reserve the right to update these terms. Material changes will be communicated via our website. Continued use of our services after changes constitutes acceptance.
